Will working affect my 100% P&T VA disability rating?

A 100% schedular disability rating is not automatically affected by employment. Unlike Individual Unemployability (TDIU), which specifically requires that a veteran be unable to secure or follow substantially gainful employment because of service-connected conditions, a schedular 100% rating is based on the severity of the disabilities themselves, as rated under 38 CFR Part 4. If you were rated 100% through the combined ratings table because your disabilities independently add up to 100%, you can generally work in any capacity, including full-time, self-employment, or unconventional work, without risking that rating being reduced solely because you are earning income.

The situation is different if your 100% rating is based on TDIU rather than schedular 100%. TDIU is tied to an inability to maintain substantially gainful employment, so taking on work that generates income above the poverty threshold for one person (adjusted annually) can prompt the VA to send a VA Form 21-4140 (Employment Questionnaire) and review whether TDIU is still warranted. Marginal employment, defined as income below the poverty threshold, or employment in a protected or sheltered setting, is generally not counted against TDIU. If you are unsure whether your 100% is schedular or TDIU-based, this distinction matters enormously before taking on new work, especially anything resembling regular, substantially gainful employment.

Also relevant is the difference between P&T (Permanent and Total) status and simply being rated 100%. P&T status means your rating is protected from routine future exams and reductions due to improvement, but it does not create blanket immunity from review if the VA has specific reason to believe fraud or misrepresentation was involved, which is rare and unrelated to simply working.

Many 100% P&T veterans pursue business ownership, consulting, trades, creative work, nonprofit founding, or part-time flexible work without any issue, provided their rating is schedular and not TDIU-dependent. If TDIU is involved, consulting with an accredited Veterans Service Officer (VSO) before starting new income-generating work is strongly advised to understand how reported earnings might be reviewed.

The concrete next step is to check your VA decision letter or eBenefits/VA.gov disability record to confirm whether your 100% rating is schedular or based on TDIU, since that single fact determines how much flexibility you have to pursue new work without risking review.
