The VA disability rating schedule, found in 38 CFR Part 4, assigns a maximum possible rating to many specific diagnostic codes. This is intentional and built into the schedule itself — some conditions, particularly certain neurological and psychiatric diagnostic codes, have a ceiling below 100% because the rating criteria for that specific code do not describe symptoms beyond that severity level. Paramyoclonus multiplex, along with several other conditions rated under 38 CFR 4.124a, is one of the conditions with a schedular maximum, in this case 60%. This cap applies only to that single diagnostic code — it does not mean your overall combined rating is capped at 60%, and it does not mean you cannot receive additional compensation if the condition affects your ability to work.
When a service-connected condition or combination of conditions prevents you from maintaining substantially gainful employment, but the schedular rating alone does not reach 100%, the relevant path is often Total Disability based on Individual Unemployability (TDIU), governed by 38 CFR 4.16. Under 4.16(a), if you have one condition rated at least 60%, or a combination of conditions with one at least 40% and a combined rating of 70%, you may qualify for TDIU, which pays at the 100% rate even though your schedular rating is lower. If you do not meet those percentage thresholds but can still show you are unemployable due to service-connected conditions, you can request consideration under 4.16(b), which is decided at the director level rather than by the rating board.

Analyze my claim free →It is also worth having the diagnostic code itself reviewed. Sometimes a condition is more accurately rated under a different or analogous diagnostic code that better reflects the actual severity and functional loss, especially when a rare or unusual condition is being rated by analogy under 38 CFR 4.20. This does not guarantee a higher rating, but it is a legitimate avenue to raise with a claims representative or accredited VSO.
The concrete next step is to file VA Form 21-8940 (Application for Increased Compensation Based on Unemployability) if the condition, alone or combined with other service-connected disabilities, prevents you from holding substantially gainful employment, and to work with an accredited Veterans Service Officer to review whether the diagnostic code and rating by analogy are being applied correctly.
