If a VA medical center eliminates or suspends a specialty department, you are not required to simply wait until the system catches up. Under the VA MISSION Act (38 CFR 17.4010), veterans can become eligible for community care when the VA cannot provide the required specialty service within certain access standards, including average drive-time and wait-time thresholds, or when VA determines it lacks a full-time equivalent provider for that specialty at the facility. If your local VA no longer has a neurologist or neurosurgeon on staff, that alone can qualify you for a community care referral. Ask your VA primary care provider or patient advocate to submit a community care consult, and if you are not offered one, file a formal request citing the MISSION Act access standards. VA Form 10-10172 is often used to request community care authorization.
For veterans mid-treatment, such as post-surgical follow-up, a sudden gap in care can create real medical risk, and it should be documented. Ask your VA facility's patient advocate office to put in writing why follow-up care was suspended and what alternative was offered; this documentation can matter later if you need to show a gap in treatment was not your fault, for example when establishing continuity of care for a disability claim tied to a worsening spine or neurological condition.

Analyze my claim free →On the claims side, interruptions in specialty care do not change the rating criteria for a condition, but missing records or gaps in treatment can weaken the evidentiary record VA uses to evaluate severity. Keep your own copies of all surgical notes, discharge instructions, and any outside specialist reports, and submit them directly with your claim or appeal rather than assuming VA will retrieve them from an outside provider.
Board of Veterans' Appeals decisions measured by VetAid (vetaid.ai/bva/outcomes) show that among 411,208 back and lumbar spine issues decided from 1992 to mid-2026, 18.3% were granted, 32.3% were denied, and 45.1% were remanded for more development; these figures describe already-appealed cases, not initial claim approval odds, and the high remand rate reflects how often additional medical evidence or exams are needed for spine claims specifically.
If your care has been disrupted, contact your VA patient advocate immediately to request a community care referral in writing and keep copies of all correspondence.
