The VA has been piloting ambient AI listening and transcription tools in some clinics to help providers create clinical notes without typing during the visit. These tools record the conversation, generate a draft note for the provider to review and edit, and then (depending on the system) delete or retain the raw audio according to VA policy. This is similar to ambient documentation tools now used in many private health systems.
Whether this violates HIPAA depends on details that vary by site and vendor, not on the fact that AI is involved. HIPAA does not prohibit recording for treatment purposes; it requires that protected health information be safeguarded, that use be limited to authorized purposes such as treatment, payment, or operations, and that any third-party vendor handling the audio operate under a business associate agreement with appropriate security controls. VA facilities are also bound by the Privacy Act of 1974 and VA's own privacy directives, which generally require notice to the patient that recording is occurring and give the patient the right to decline. If you were recorded without being told, or you were not given the option to opt out, that is worth raising directly with the facility's privacy officer, since consent and disclosure practices can differ by site during a rollout like this.

Analyze my claim free →For disability claims purposes, the more practical question is how these AI-generated notes end up in your electronic health record, since that record can later be pulled for compensation and pension exams, nexus reviews, or audits of your claimed conditions. AI-transcribed notes can contain transcription errors, so it is reasonable to ask your provider to let you review the generated note before it is finalized, just as you would review any other clinical documentation, since inaccurate wording in a progress note can complicate a future claim if the note misstates symptoms, onset dates, or severity.
There is no indication that use of this technology changes VA's disability rating criteria, evidentiary standards, or appeal rights under 38 CFR Part 4 or 38 USC Chapter 51. It affects how notes are created, not the substantive rules VA uses to decide claims.
If you are concerned about a specific recorded visit, ask your treatment team whether the encounter was recorded, request a copy of the resulting note, and file a written privacy complaint with the facility's privacy officer if you were not given notice or an opportunity to opt out.
