How does the VA decide P&T status when I'm rated 100% or over 95% with static conditions but the decision letter doesn't mention P&T?

Reaching a 100% combined rating does not automatically mean you have been granted Permanent and Total (P&T) status. "Total" refers to the 100% combined schedular (or TDIU) rating, while "Permanent" is a separate determination that your service-connected conditions are static and not expected to improve. The VA makes this permanence determination by looking at whether any future re-examinations are scheduled for the conditions supporting your rating. If every condition contributing to your 100% rating is coded as static, with no future exam scheduled, the rating decision should reflect P&T, usually stated explicitly in the "Reasons for Decision" section or in the benefit letter itself.

Sometimes VBA's automated systems process the numeric rating before a human reviewer or a second system pass updates the permanence flag, which can create a lag between the rating being posted online and the official determination showing correctly. This is why call center representatives sometimes give inconsistent answers, since they may only see partial system data rather than the finalized rating decision packet.

If your official decision letter arrives and does not reflect P&T despite all conditions being static and the combined rating meeting the requirement, you have a few options. You can submit a Decision Review Request using a Higher-Level Review (VA Form 20-0996) if you believe the omission was a clear and unmistakable error in the rating decision, since P&T status affects ancillary benefits like Dependents' Educational Assistance, waiver of dependents' processing, and often SGLI premium waivers. Alternatively, you can contact the VA directly, request a formal correction, or submit an inquiry through Ask VA and ask them to review the static coding and future-exam data actually entered in the rating decision, not just the percentage. Keep a copy of both the online decision and the eventual mailed letter, since discrepancies between the two are common and documenting them will support any correction request.

The concrete next step is to wait for the official mailed decision letter, check whether it lists any scheduled future exams, and if none are listed despite the 100% static rating, file a Higher-Level Review request citing clear error in the omission of P&T status.
