C&P examiner not including majority of my issues in evaluation

You can and should challenge an inadequate Compensation & Pension (C&P) examination, as the examiner’s opinion is not final and can be overcome with probative evidence. The foundational principle is that all relevant evidence must be considered under 38 CFR 3.303, and for mental health claims, the evaluation must be based on the totality of the symptoms and their occupational and social impairment as outlined in the Diagnostic Code (DC) 9411 criteria under 38 CFR 4.130. The examiner’s failure to address your reported symptoms or consider your private medical records may render the exam inadequate under *Barr v. Nicholson*, which holds that an examination is insufficient if it does not address all the veteran’s disabilities. Your actionable next steps are to formally identify this as a “Clear and Unmistakable Error” (CUE) in the exam itself or, more effectively, submit a Supplemental Claim (VA Form 20-0995) with new and relevant evidence, specifically highlighting the examiner’s omissions. This new evidence should include a detailed personal statement addressing each unmentioned symptom, your private doctor’s records, and, crucially, an independent medical opinion (IMO) from a private physician that directly rebuts the C&P examiner’s findings and provides a rationale for a higher evaluation. Cite the specific symptoms and functional impairments from DC 9411 that the examiner ignored. Concurrently, you can report the examiner’s conduct to the VA’s Office of Accountability and Whistleblower Protection.
