Can I work full-time on a 100% P&T rating without losing my VA benefits?

A 100% schedular rating that has been designated Permanent and Total (P&T) is fundamentally different from Total Disability based on Individual Unemployability (TDIU). TDIU is granted specifically because a veteran's service-connected conditions prevent them from securing or maintaining substantially gainful employment, so earning above the poverty threshold (marginal employment) can trigger a review and potential reduction under 38 CFR 4.16. A 100% schedular rating, by contrast, means the combined rating for your service-connected disabilities itself equals 100 percent under the rating schedule (38 CFR Part 4), independent of your employability status. There is no regulation that reduces a 100% schedular rating simply because you are working. The rating reflects the severity of the medical conditions, not your income or employment status.

The P&T designation adds another layer of protection. Permanent means the VA has determined your condition is not expected to improve, and Total means you meet the 100% threshold. Once a rating is both permanent and total, it is generally protected from routine future examinations and reductions, per 38 CFR 3.327, which exempts P&T ratings from being scheduled for reexamination except in unusual circumstances (such as evidence of fraud or clear misdiagnosis at the time of the original grant). Additionally, ratings in effect for 20 years or more become protected from reduction below the level held for those two decades under 38 CFR 3.951, though P&T status already offers stronger protection much sooner.

So working while rated 100% P&T does not by itself put your benefits at risk. The VA does not monitor your W-2s or employment records to reduce a schedular 100% rating. The distinction your VSO likely raised in the past was in the context of whether you might have qualified for or been pursuing TDIU, where work history and earnings are directly relevant. Since you are confirmed schedular 100% and not TDIU, that concern does not apply to your current rating.

The appealed VA decisions in VetAid's library show that TDIU cases are frequently contested on appeal, with a majority vacated or remanded rather than outright affirmed or denied, but this data concerns appellate outcomes for unemployability claims specifically and is not representative of how schedular 100% P&T ratings are handled, since those are a different legal basis entirely and this data reflects only appealed decisions, not typical case outcomes.

As a concrete next step, request written confirmation of your permanent and total designation from the VA (visible on your decision letter or through eBenefits/VA.gov) so you have clear documentation if any employment-related question ever arises.
